Ett annat minnesvärt exempel är hur svenska Ifpi påstod att fildelningen gått ner i Finland till följd av införandet av Ipred-direktivet, för att motivera dess införande här i Sverige. I Finland hade dock tv-bolaget MTV3 redan hunnit konstatera att så inte var fallet. Siffrorna var falska och upphovsrättsorganisationerna där fick ta tillbaka det offentligt.
På samma sätt lyfte Frankrikes dåvarande kulturminister, Christine Albanel, om och om igen fram den svenska Ipredlagen som exempel på framgångsrik internetpolitik. Tvivelaktig svensk statistik fick ligga till grund för västvärldens strängaste lagar på området. Sverige sågs, av den franska regeringen och upphovsrättslobbyn, som ett föredöme.
Det blir därför en närmast komisk rundgång när Henrik Pontén, utan att uttryckligen säga det, framhåller vissa av de franska åtgärderna mot fildelning som föredöme för svensk lagstiftning. Myndigheten HADOPI (la Haute Autorité pour la Diffusion des Œuvres et la Protection des Droits sur Internet) har bland annat den uppgift Pontén nu vill ge en svensk myndighet eller instans: skicka varningsbrev till misstänkta ”fildelare”. HADOPI skall snart börja skicka både massmail och varningsbrev på uppdrag av upphovsrättsinnehavare – men de franska internetleverantörerna är dessutom enligt lag skyldiga att samarbeta. Om de inte gör det hotas de av stränga vitesstraff.
Kritiker avfärdar dock myndigheten som en komplicerad, kostsam, meningslös och ineffektiv spam-maskin. Frågan är om Pontén och de intressen han representerar verkligen vill dra igång en politisk process för att skapa en sådan instans i Sverige. Särskilt som den turbulenta franska debatten, som gjort en stor del av den politiska klassen till åtlöje, borde förskräcka.
Det uppstår flera frågor om vad Pontén egentligen vill: Vilka tänker han sig skicka breven till? Och enligt vilka kriterier? Vem skall leta fram IP-adresserna? Vill han ha sänkta beviskrav?
Svaren på dessa frågor står att finna pusselbitar från både förslag till och genomförd lagstiftning runt om i världen. De fall vi nämner inledningsvis är dessvärre bara ett fåtal. Det pågår en krass internationell kampanj att förhindra utvecklingen på internet, en kampanj vars förhållande till sanningen är tämligen elastiskt.
I Brasilien får man höra att man är värst på att fildela, i Danmark, i USA, i Storbritannien, i Spanien, i Frankrike… en ändlös loop av falska anklagelser om hur förskräckligt illa det är regionalt. Ofta lyckas de övertyga makthavarna och medborgarna tvingas hjälplöst se på medan den ena lagen efter den andra drivs igenom. Men upphovsrättsindustrins företrädare tycks aldrig nöja sig med åtgärderna. När ett steg är taget, stampar de ivrigt för att få ta nästa. Vi kan inte låta bli att undra när de kommer att bli nöjda. Blir de någonsin det?
Svaret man kan gissa sig till, baserat på historiska insatser från grupper som antipiratbyråer, Ifpi och andra särintressen, är djupt oroande.

Med detta i bakfickan, vill vi därför tacka Antipiratbyrån för att de tycks ha bestämt sig för att ägna valåret 2010 till att hjälpa Piratpartiet in i riksdagen. Det innebär att efter höstens val kommer det att finnas åtminstone ett parti i Sveriges riksdag som sätter käppar i hjulet för upphovsrättsindustrins frammarsch.

Har faktiskt testat att göra så nån gång tidigare. Den överväldigande största andelen svar gick ut på att de inte uppskattade att inte bli tillfrågade specifikt. Det är möjligt att jag gjorde det fel, eller uttryckte mig dumt, men rådet jag fick var att ringa upp redaktionen, fråga om de är intresserade och sen skicka till dom exklusivt. Nobbar dom, ser jag ingen anledning att inte prova med någon annan, iofs, men det var i alla fall den lärdomen jag gjorde då.
Det som tidningar gör sina bedömningsgrunder på är oftast aktuellt ämne, lokalförankring osv. I ovanstående fall lyckades vi inte riktigt pricka in det.

I en annars välskriven artikel vill jag ställa mig skeptisk till en del av retoriken. Är det bra att vi häcklar APB genom formuleringar som

Visst är det lite kul, men det antyder tyvärr att vi ser positivt på APBs galenskaper. Som om vi liksom Anticimex tjänade pengar på skadedjur. Som om Sossarna skulle tacka Moderaterna varje gång de sänker A-kassan.
Som jag ser det är PP är en nödvändighet. Vi önskar att vi inte behövdes, men på grund av att mediaindustrin försöker upprätta ett korporativt system tvingas vi kliva fram. Om mediaindustrin börjar anpassa sig till verkligheten, eller våra politiker inser vem de egentligen företräder, lägger vi med en lättnades suck Jolly Roger på hyllan. Det kanske skulle finnas nån som är intresserad. Det är lite jonglering mellan heltidsjobb, tidigare utfästelser, färskhet på inlägget osv som spelar roll. Och inte minst erfarenhet för hur man går tillväga. Så jag tänkte skriva några rader om misströstan och optimism.
Jag misströstar tidvis något oerhört på grund av att vi får så lite utrymme i gammelmedia, samtidigt som upphovsrättslobbyn och terroristoffren (Bodström, Ask & co) i princip kan stå oemotsagda.
Men ibland tänker jag att ju fler repressiva lagar som införs, desto mer effektiv och allmänt tillgänglig anonymiseringsteknik kommer vi att få.
Och desto fler kommer att använda den, av allt enklare orsaker.
Så i mina mest optimistiska stunder tror jag att det enda som kan åstadkommas med repressiva lagar är – i stort sett ingenting.
Men en sådan from förhoppning är inget att bygga någon framtid på, det kan möjligen vara till tröst när tillvaron ser mörk ut.
För att bygga en framtid måste vi in i riksdagen och då behöver vi nog dessvärre utrymme i gammelmedia.
